
Justice Department sues DC’s attorney disciplinary authorities for recommending a Trump ally be disbarred
The Justice Department has filed a lawsuit against Washington, DC’s attorney disciplinary authorities over their recommendation to disbar Jeffrey Clark, a Trump ally and former assistant attorney general, for his efforts to challenge the 2020 election results. Clark had drafted a letter urging Georgia’s state legislature to investigate alleged election irregularities and potentially appoint electors that contradicted the popular vote outcome. The DOJ argues that Clark should not face discipline for “internal Executive Branch deliberations,” claiming that such disciplinary actions would chill attorneys’ ability to provide candid legal advice within the administration. The DC Board on Professional Responsibility had recommended Clark’s disbarring in July 2025, finding he attempted to persuade DOJ leadership to issue the letter despite being told his theory was incorrect. The lawsuit reflects the Trump administration’s broader pushback against state bar oversight of federal attorneys, as it simultaneously pursues renewed scrutiny of the 2020 election, including investigations into Georgia’s Fulton County.
