The association pointed to recent social media posts by an administration official naming specific judges, describing them as part of a broader pattern of threats and intimidation aimed at the judiciary. The ABA drew a line between legitimate criticism — analyzing and debating opinions, or challenging them on appeal — and inflammatory rhetoric, unfounded accusations and demands that judges be removed for their decisions, which it said erode public confidence and judicial independence. Calling judicial independence a nonpartisan cornerstone of democracy, the statement asked members of the legal profession to speak publicly in defense of courts and the rule of law.
